OLDSMAR PERSONAL INJURY ATTORNEY

Reinventing Personal Injury Representation
250+ 5-Star Reviews

An Oldsmar personal injury attorney represents people hurt by someone else's negligence in Oldsmar and across Pinellas County, handling the insurance claim, the evidence and the lawsuit if one becomes necessary. Neal & Solevilla is a Clearwater firm led by two Board Certified Civil Trial attorneys, about 20 minutes from Oldsmar down McMullen Booth Road. There's no fee unless we recover money for you.

What Oldsmar clients most often ask us

  • How long do I have? Two years from the date of a negligence injury, for claims arising on or after 24 March 2023 (Fla. Stat. § 95.11(5)(a)). Older claims may still fall under the previous four-year rule.
  • What will it cost? Nothing up front. We work on contingency and are paid only from a settlement or verdict.
  • Which county is my case in? This matters more in Oldsmar than almost anywhere else in Pinellas. The city sits on the Hillsborough line, and a crash a short distance east on SR 580 can land in a different circuit, a different courthouse and a different clerk.
  • What if I was partly at fault? You can still recover, as long as you're not found more than 50 percent responsible (Fla. Stat. § 768.81(6)).
  • Do I have to come to your office? No. We take Oldsmar consultations by phone or video, and we'll come to you if travel is difficult.

We know this corner of the county, including the part most firms get wrong. Oldsmar has no courthouse of its own. Pinellas cases are filed with the Clerk of the Circuit Court at 315 Court Street in Clearwater and heard in the Sixth Judicial Circuit. But Oldsmar sits directly on the Hillsborough County line, and a crash that happens a short distance east belongs to the Thirteenth Judicial Circuit at the George Edgecomb Courthouse in Tampa instead. Different clerk, different rules of practice, different filing. Getting that call right at the start saves months.

WHERE ACCIDENTS HAPPEN IN OLDSMAR

Oldsmar is a city of about 14,500 people (US Census Bureau, 2025 estimate) with a highway running through the middle of it. That combination shows up in the data.

Forward Pinellas, the county's transportation planning agency, studied the downtown area south of Tampa Road as part of its Safe Streets Pinellas programme, using crash records from 2018 to 2023. Its finding was direct: SR 580 is the corridor carrying the majority of crashes, including those involving pedestrians and cyclists. St. Petersburg Drive, State Street and Lafayette Boulevard came next.

The specifics are worth reading, because they explain what these crashes look like:

  • SR 580 between St. Petersburg Drive and Lafayette Boulevard: 143 crashes over the six years, with three deaths and three serious injuries.
  • SR 580 at Forest Lakes Boulevard: 36 crashes, four of them involving someone on foot or on a bike.
  • Across the whole study area: 312 crashes, 92 of them causing at least one injury, and four deaths. Three of the four people killed were pedestrians.

Pedestrian and cyclist crashes made up only 4 percent of the total, but 75 percent of the fatal ones. The engineers' own site notes explain why. SR 580 is an eight-lane road east of Tampa Road with high speeds and high volume. At the SR 580 and St. Petersburg Drive crossing, they measured 130 feet of open road with no pedestrian refuge in the middle. During the walking audits they watched a truck drive over the pedestrian refuge at the northwest corner, and recorded "super wide turn radii on all intersection legs" and short pedestrian signal phases. One rear-end crash in the file involved a vehicle travelling above 80 mph and produced a death, a serious injury and six other injuries.

Trucks are part of the picture here in a way they aren't in most Pinellas towns. Oldsmar's commercial and industrial land sits just north of downtown, along Race Track Road and Commerce Boulevard, and that freight has to reach the Tampa Road and SR 580 corridor to get anywhere. Across Pinellas County there were 1,397 commercial vehicle crashes in 2024, causing 325 injuries and 7 deaths (Florida Highway Safety and Motor Vehicles). A collision with a loaded truck is a different case from a fender bender, with a different insurer, federal driving-hour records to obtain and usually a much larger policy behind it.

AFTER A CRASH IN OLDSMAR: WHERE YOU'LL BE TREATED

Where you're taken shapes your claim, because those first records become the spine of the medical evidence. Oldsmar sits between two hospital systems and two counties, so it varies:

For a severe trauma you'll be taken out of the area entirely. None of the hospitals above is a state-designated trauma centre. The nearest Level I is Tampa General, with St. Joseph's in Tampa at Level II, per the Florida Department of Health's trauma centre list. That's another reason an Oldsmar case so often ends up straddling two counties.

One deadline catches people out. Florida's no-fault system pays up to $10,000 in medical and disability benefits, but only if you receive initial care within 14 days of the crash. Miss that and your own PIP coverage pays nothing. And if a doctor determines you didn't have an emergency medical condition, the cap drops to $2,500 (Fla. Stat. § 627.736).

Where to Start with a Personal Injury Claim in Oldsmar

After an accident, you may get calls from insurance companies to sign paperwork you don’t understand. Working with a personal injury attorney can help you take some of that stress off your plate so you can focus on recovering.

One of the first avenues we explore is an insurance settlement:

  • Homeowners insurance

  • Auto insurance

  • Business liability insurance

Insurance companies don’t want to make it easy for you. But don't worry, our Oldsmar injury attorney will handle all the negotiations and legal pressure so you can get what you deserve.

If the claim has to become a lawsuit, the first question is which county it belongs to. A crash within Oldsmar is filed with the Pinellas County Clerk of the Circuit Court at 315 Court Street, Clearwater, and heard in the Sixth Judicial Circuit. A crash on the far side of the county line goes to the Thirteenth Judicial Circuit at the George Edgecomb Courthouse, 800 E. Twiggs Street, Tampa. In either county, claims over $50,000 are circuit civil matters and those between $8,000 and $50,000 go to county civil (Fla. Stat. § 34.01).

What is the Timeline?

We know the legal process can feel overwhelming and daunting, but we are here to make it simple and clear.

A general timeline of how an Oldsmar personal injury claim typically unfolds:

  1. Notifying Responsible Parties: We file your claim and notify insurance companies and anyone responsible for your injuries.
  2. Building Your Case: Our team gathers police reports, medical records, witness statements, and other important evidence.
  3. Settlement Negotiations: We work to reach a fair settlement with the at-fault party or their insurance company.
  4. Filing a Lawsuit (If Needed): If a fair settlement is not offered, we can file a lawsuit and continue fighting for you.
  5. Litigation and Evidence Preparation: We interview witnesses, consult experts, and strengthen your case.
  6. Mediation, Arbitration, or Trial: If settlement negotiations fail, your case may move to mediation or trial to seek the best outcome.

When you hire Neal & Solevilla, you get a team that’s deliberate, experienced, and focused on protecting your future. From day one, we explain your options and create a clear strategy.

What Damages Can an
Oldsmar Personal Injury Attorney Pursue?

Filing a personal injury claim isn’t just about the money. It is about protecting your future after someone else’s careless actions. A serious accident can lead to hefty bills, lost income, and long-term challenges for you and your family.

In legal terms, damages are the compensation awarded to injury victim(s) for the losses they’ve suffered after an accident, including:

  • Physical
  • Emotional
  • Financial

Our job as your Oldsmar attorneys is to fight for what you need to move forward.

Types of Compensation

Here are some of the common types of compensation we pursue for our clients:

Economic Damages

  • Medical costs: Coverage for hospital stays, doctor visits, prescriptions, physical therapy, and other medical care related to your injury.
  • Future medical needs: Compensation for continued treatment, rehabilitation, or long-term care required for serious or permanent injuries.
  • Lost wages: Repayment for income you were unable to earn while recovering from your injury.
  • Loss of future earning capacity: If your injury limits your ability to work or reduces your long-term income potential.
  • Property damage: Payment to repair or replace damaged property, such as your vehicle or personal belongings.

Non-Economic Damages

  • Pain and suffering: Compensation for the physical pain and emotional hardship caused by the accident.
  • Emotional distress: Coverage for mental and emotional effects such as anxiety, depression, or post-traumatic stress.
  • Loss of companionship: If your injuries have affected your relationship with a spouse or close family member.
  • Loss of enjoyment of life: Compensation for the inability to enjoy hobbies, activities, or daily routines you once loved.

One rule shapes the value of nearly every Florida claim. Under Fla. Stat. § 768.81(6), a person found more than 50 percent at fault for their own harm recovers nothing. Below that line, the award is reduced by your share of the blame. It's why adjusters push so hard, so early, to get you on record saying something that shifts fault your way. Medical negligence claims under chapter 766 are carved out of that bar.

FAQs

Two years from the date of the injury, for negligence claims arising on or after 24 March 2023, when HB 837 cut the deadline from four years. If your injury happened before that date, the older four-year period may still apply, which is worth checking rather than assuming. Certain claims carry shorter deadlines still, so get advice early.

Nothing up front. We work on a contingency fee, which means we're paid a percentage of what we recover for you and nothing at all if we don't recover anything. You'll get the percentage in writing before you sign.

Get medical care, and do it within 14 days or your own PIP coverage pays nothing toward your treatment. Photograph the scene, the vehicles and your injuries if you're able. Get names and numbers for anyone who saw it. Report the crash. Then be careful what you say to the other driver's insurer, because a recorded statement in week one is the single most common way a good claim gets damaged.

Not every claim needs one. The practical test is whether anyone is disputing fault, whether you needed more than a single visit's treatment, or whether the offer on the table would leave you paying for care yourself. If any of those apply, get advice before you sign anything. A local firm also means someone who knows which county your case belongs to, which is not always obvious in Oldsmar.

It depends on which side of the line the crash occurred, not where you live. A crash inside Oldsmar is a Pinellas County matter, filed at 315 Court Street in Clearwater and heard in the Sixth Judicial Circuit. Cross into Hillsborough and it belongs to the Thirteenth Judicial Circuit at the George Edgecomb Courthouse in Tampa. Different clerk, different local practice. We work out which applies before anything gets filed.

Truck cases run on a different track. There's usually a much larger insurance policy, a company behind the driver, and federal records including driving-hour logs, maintenance history and often electronic data from the vehicle. Those records can be overwritten or destroyed on the carrier's normal retention schedule, so a preservation letter needs to go out quickly. Pinellas County recorded 1,397 commercial vehicle crashes in 2024, causing 325 injuries (FLHSMV).

You can still recover, as long as you're not found more than 50 percent responsible. Past that point Florida law bars recovery entirely (Fla. Stat. § 768.81(6)). Below it, your compensation is reduced in proportion to your share of fault. Fault is argued, not fixed, which is exactly why the first week matters so much.

Car and truck crashes on SR 580 and Tampa Road, pedestrian and cyclist collisions, motorcycle crashes, rideshare accidents, slip and falls on commercial property, and wrongful death claims. Each case is assessed individually for liability and likely compensation.
